These Terms of Use ("Terms") govern your access to and use of xginfotech.com(the "Site"), operated by XG Information Technology Corp ("XG," "we," "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms cover this marketing website only. Engagements for custom software work are governed by a separate written agreement (Statement of Work or Master Services Agreement) signed by both parties — the marketing copy on this Site does not itself create that agreement.

Use of the Site

You may view this Site for lawful purposes — to learn about our services, to read our methodology, to evaluate whether to engage us. You agree not to:

  • Use the Site in any way that violates applicable law.
  • Attempt to interfere with or compromise the Site's integrity, security, or availability.
  • Scrape, crawl, or harvest data from the Site at a volume or rate that imposes an unreasonable load on our infrastructure.
  • Use the Site to transmit harmful code, conduct unauthorized security testing, or otherwise harm XG or third parties.

Intellectual property

The Site and its contents — including text, graphics, logos, the XG and XGInfoTech marks, the methodology page, and the design system — are owned by XG or our licensors and are protected by copyright, trademark, and other intellectual-property laws. You may view and reasonably quote our content with attribution. You may not copy, modify, distribute, or create derivative works from the Site for commercial purposes without our written permission.

Names of clients and partners shown on the Site are referenced solely to describe past work and are the property of their respective owners.

Submissions and inquiries

When you contact us — through email, the contact form, the project quote tool, or any other channel on the Site — you confirm that the information you provide is accurate and that you have the right to share it. We'll use what you send under our Privacy Policy. Submissions don't create a contract, an attorney-client or other professional relationship, or a binding scope until both parties sign a written agreement.

Forward-looking statements and methodology claims

The Site discusses our delivery methodology, including statements about cost reduction, speed, and quality outcomes (for example, "30–50% lower cost" and "2–3x faster on well-scoped work"). These reflect our experience on engagements that fit the methodology's assumptions. Outcomes vary by scope, codebase complexity, organizational constraints, and other factors. The honest caveats described on the Site (for example, on the methodology page's failure-modes section) are part of the picture. None of the claims on this Site are a guarantee of a specific outcome on a specific engagement.

To the fullest extent permitted by law, XG disclaims all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of content. Limitation of liability

To the fullest extent permitted by law, XG and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Site — even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to the Site is limited to one hundred US dollars ($100).

Indemnification

You agree to indemnify and hold XG harmless from any claim arising out of your breach of these Terms or your misuse of the Site.

Governing law and venue

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in King or Snohomish County, Washington, and you consent to personal jurisdiction there.

Changes

We may update these Terms from time to time. The "last updated" date at the top of the page reflects the most recent version. Continued use of the Site after a change constitutes acceptance of the updated Terms.
